Disclaimer and Limitation of Liability

1. Preamble and Scope of Services

The Platform is owned and operated by Loris Croci, born in Busto Arsizio on 28 October 1992, Italian Tax Code (C.F.) CRCLRS92R28B300V, resident at Via Fraquelli no. 19, Muronico (hereinafter, the "Owner").

The Platform enables users to create a personal profile, publish and browse events dedicated to the freediving sector, as well as publish and browse listings relating to products and services in the same sector.

The Platform is a purely digital notice board and does not constitute a marketplace in any form: it does not intermediate or manage financial transactions between users, but merely displays the listings published by users themselves, facilitating connection and interaction among members of the freediving community.

Any contact between users takes place through the e-mail mediation system managed by the Owner via the Platform, while any financial transaction occurs exclusively outside the Platform and remains the sole responsibility of the parties involved.

Neither the Platform nor the Owner assumes, in any capacity, the role of organiser, promoter, intermediary, tour operator, or manager of sporting or diving events.

2. Use of the Platform and User Responsibility

The user acknowledges that use of the Platform, as well as participation in events, freediving sessions or activities published thereon, occurs entirely at their own risk.

The user undertakes to:

fully comply with applicable legislation on safety in underwater and sporting activities;
act in a prudent, diligent and respectful manner during activities and interactions with other users;
verify their own physical fitness, certifications and competences, as well as the suitability of environmental conditions, prior to participating in any activity;
not rely exclusively on information or data provided by other users through the Platform.

The Owner, through the Platform, exercises no prior or subsequent control over the conduct of users, published events, entered data, or the conditions of the locations where activities take place.

The user hereby indemnifies and holds harmless the Owner, its potential employees and collaborators from any liability, claim, demand for compensation, damage, cost or expense, including legal fees, arising from or connected to the use of the Platform, participation in underwater or sporting activities published thereon, or any breach of the Platform's terms and conditions.

3. User-Generated Content and Events

Listings and events published on the Platform are created and managed autonomously by users.

The Owner, through the Platform, does not verify the truthfulness, completeness, accuracy or lawfulness of the information entered by users, nor the actual holding of events published by them.

The Platform merely displays user-uploaded content without exercising any editorial control over it.

Data relating to, inter alia, depth, duration and other performance metrics voluntarily entered by users do not constitute in any way medical documentation or fitness certification.

Any errors, omissions or inaccuracies in content published by users on the Platform — including, by way of example and without limitation, information relating to events, characteristics of products or services offered, technical diving data or environmental conditions — shall not in any way give rise to liability on the part of the Owner for damage of any nature suffered by users or third parties as a consequence of relying on such content, including physical harm, financial loss, data loss or any other adverse consequence.

4. User Contact System

The user contact system operates through e-mail mediation by the Platform: when a user clicks "Contact" in relation to an event or listing published by users on the Platform, the Platform transmits to the recipient an e-mail notification containing the sender's e-mail address and message.

The Owner, through the Platform, does not store the content of messages exchanged between users.

The Owner is not responsible for the content of communications made between users or for the consequences arising from contacts made through the Platform.

5. Absence of In-Platform Payments

The Platform does not incorporate any payment system.

All financial transactions possibly taking place between users in relation to events or listings published on the Platform occur outside the Platform and are the exclusive responsibility of the parties involved.

The Owner is in no way a party to such transactions and assumes no liability in connection with them.

6. Technological Infrastructure and Service Continuity

The Platform is developed using the Laravel framework (PHP) and operates in a Docker environment on private virtual servers (VPS) located within the European Union, with separate staging and production environments.

User data is stored in a PostgreSQL database.

Files uploaded by users to the Platform are subject to anti-malware scanning.

Backups are performed periodically, encrypted, and stored separately from the production environment, with encryption keys kept offline and not present on production servers.

Operational mailboxes are managed through an e-mail provider based within the European Union.

Transactional communications (account confirmation, password reset, system notifications, etc.) are sent via Resend.com with infrastructure located within the European Union.

The Owner undertakes to maintain an adequate level of service availability and security, but does not guarantee uninterrupted continuity or the absence of errors.

Any suspensions or interruptions due to maintenance, updates or force majeure events do not entitle users to any refund, except in cases of wilful misconduct or gross negligence directly attributable to the Owner.

The Owner is not responsible for malfunctions attributable to third-party services.

7. Personal Data Processing and Absence of Profiling

The Owner does not collect users' personal data for advertising purposes and does not use behavioural tracking tools.

The Owner does not employ, through the Platform, automated decision-making processes that produce legal effects or similarly significant effects on users.

Personal data provided by users during registration and use of the Platform is processed by the Owner in compliance with applicable personal data protection legislation, and in particular Regulation (EU) 2016/679 (GDPR).

8. Exclusion and Limitation of Liability

Without prejudice to all exclusions and limitations of liability set out elsewhere in this document, to the maximum extent permitted by law, the Owner shall not be liable for any damage, loss, injury or other consequence, direct or indirect, arising from:

use of or malfunctions in the Platform or its features;
inaccurate, incomplete or outdated content published by users;
acts, omissions or negligence of users or third parties;
service interruptions, network errors or temporary unavailability of the Platform;
organisation, management or participation in activities between users;
financial transactions occurring outside the Platform.

9. Indemnification and Assumption of Risk

Without prejudice to all further exclusions and limitations of liability set out in this document, to the maximum extent permitted by law, the user declares to have understood the nature of the Platform and to fully assume all risks arising from their participation in sporting activities or use of the services.

The user undertakes to indemnify and hold harmless the Owner, its potential employees and collaborators from any liability, claim or demand for compensation arising from or connected to their use of the Platform or participation in underwater or sporting activities.

10. Updates, Governing Law and Jurisdiction

The Owner may at any time and for any reason amend the provisions of this Disclaimer, without any obligation to provide prior notice to users.

Such amendments shall take effect upon publication on the Platform.

The invalidity, even if partial, of one or more clauses of this Disclaimer shall not entail the invalidity of the document as a whole, nor of the remaining part of any partially invalid clause.

The contractual relationships between the Owner and users arising from this Disclaimer are governed by Italian law.

For any dispute, the Court of Milan shall have exclusive jurisdiction, except where mandatory jurisdiction rules apply by law.
