Terms of Service

These Terms of Service (the "Terms") govern your access to and use of FreedivingHome, accessible at freedivinghome.com.
By creating an account, ticking the acceptance checkbox, or using account-based features of the Platform, you accept these Terms. If you do not accept these Terms, you must not create an account or use the Service.
During registration, you may also be asked to provide a separate and distinct approval of certain clauses listed in Annex A under Articles 1341, paragraph 2, and 1342 of the Italian Civil Code.
The Privacy Policy, available at freedivinghome.com, explains how personal data is processed. The Privacy Policy is provided separately and should be read together with these Terms. It does not limit or waive any rights you have under applicable data protection law.
1. Definitions
For the purposes of these Terms:
- Service Provider, Owner, we, us, or our means Loris Croci, the natural person identified in Section 2.
- Platform, App, or FreedivingHome means the online platform accessible at freedivinghome.com, including any official web interface, application interface, or related feature made available by the Service Provider.
- Service means the features and functionalities made available through the Platform, as described in Section 3.
- User, you, or your means any natural person who accesses, registers on, or uses the Platform.
- Consumer means a natural person acting for purposes unrelated to any business, trade, craft, or professional activity, within the meaning of the Italian Consumer Code.
- Account means the personal account created by a User upon registration.
- Content means any text, image, file, data, listing, event notice, profile information, logbook entry, or other material made available on or through the Platform.
- User-Generated Content or UGC means any Content submitted, uploaded, published, transmitted, or otherwise made available by a User.
- Listing means a notice-board-style publication created by a User in relation to goods, services, equipment, activities, or other freediving-related matters. A Listing is not a sale offer made by the Service Provider.
- Event means a notice-board-style publication of a freediving-related event or activity created by a User. An Event is not organised, managed, endorsed, or supervised by the Service Provider.
- Buddy means another User with whom you interact through the Platform's community features.
- Logbook means the personal record of dive activities voluntarily entered by a User.
- Declared Certification Level means a certification level or experience level voluntarily stated by a User. It is not verified by the Service Provider.
- Contact Function means the email-mediation feature described in Section 9.
- Privacy Policy means the data protection notice made available by the Service Provider under Article 13 GDPR.

3. Description of the Service
3.1 What the Platform is
FreedivingHome is a social platform dedicated to the freediving community.
The Platform may provide, depending on availability and development phase:
- creation and management of a personal profile;
- display of a Declared Certification Level, which is not verified by the Service Provider;
- a personal Logbook for voluntarily recording dive activities such as depth, duration, location, discipline, and notes;
- creation, publication, and browsing of Events;
- creation, publication, and browsing of marketplace-style Listings;
- Buddy interactions and community features;
- a Contact Function for user-to-user communication through email mediation;
- upload of photos and files, subject to technical and security checks.
The Platform may be operated in pre-launch, invite-only, or allowlist mode before full public availability. During this phase, access to some or all features may be limited.
3.2 What the Platform is not
FreedivingHome is a digital notice board and community platform.
It is not:
- a marketplace operator;
- a payment processor;
- an escrow service;
- a trust service;
- a financial intermediary;
- a broker or commercial agent;
- a seller or buyer of goods or services listed by Users;
- an organiser, promoter, intermediary, tour operator, instructor, supervisor, or safety controller of sporting, recreational, freediving, or diving events;
- a guarantor of the truth, accuracy, legality, safety, quality, availability, or suitability of any User, Declared Certification Level, Listing, Event, Buddy interaction, or UGC;
- a medical authority;
- a training organisation;
- a certification body;
- an emergency service.
The Platform does not process payments, hold funds, collect commissions, provide escrow, or intermediate financial transactions between Users.
Any agreement, transaction, payment, participation, meeting, dive, training activity, or other arrangement between Users takes place outside the Platform and remains the sole responsibility of the Users involved.
3.3 Consumer information summary
For the purposes of applicable consumer-law information duties:
- the main characteristics of the Service are described in these Terms, especially Sections 3, 7, 8, 9, and 10;
- the Service Provider's identity and contact details are provided in Section 2;
- the Service is currently provided free of monetary charge;
- no in-platform payment system is provided;
- no delivery of physical goods is provided by the Service Provider;
- the Service is performed digitally and access normally begins after account creation, subject to invite, allowlist, technical, security, or availability limits;
- the contract is for an indefinite period and may be terminated by the User as described in Section 16.2;
- the Platform is an online digital service accessible through compatible devices, browsers, and internet connections;
- authentication, access controls, malware scanning, and other security measures may apply;
- withdrawal rights are described in Section 18;
- complaints and notices may be sent to [email protected].
If future paid features are introduced, they will be subject to separate pricing information and, where necessary, separate terms or acceptance steps. The current free Service will not automatically convert into a paid service without your express agreement.
4. Eligibility and Registration
4.1 Minimum age
The Service is intended for Users aged 16 years or older.
Where the law of your country of residence requires a higher minimum age to use this type of service, that higher age applies.
If you are below the age of majority in your country of residence, you may use the Service only with the consent and supervision of a parent or legal guardian, unless applicable law allows you to validly enter into these Terms on your own.
The Service Provider does not knowingly allow registration by persons below the applicable minimum age. If the Service Provider becomes aware that an Account has been created by a person below the applicable minimum age, the Account may be deleted.
4.2 Registration
To access certain features, you must create an Account.
You agree to provide accurate, current, and complete information during registration and to keep your Account information up to date.
4.3 One Account per User
Unless expressly authorised by the Service Provider, each User may hold only one Account.
You must not:
- create multiple Accounts to bypass restrictions or moderation measures;
- register under a false identity;
- impersonate another person;
- misrepresent your identity, experience, certification, affiliation, or intentions.
5. Account Security
You are responsible for safeguarding your Account credentials and for activities carried out through your Account, except where unauthorised activity is caused by the Service Provider's breach of mandatory legal duties.
You must:
- choose a strong and unique password;
- keep your login credentials confidential;
- not share your Account with third parties;
- promptly notify the Service Provider at [email protected] if you suspect unauthorised access, credential compromise, or misuse of your Account.
The Service Provider may require password resets, temporary access restrictions, or additional verification where reasonably necessary for security.
6. Acceptable Use
You agree not to use the Service to:
- publish, upload, transmit, or promote unlawful, defamatory, threatening, harassing, hateful, discriminatory, obscene, abusive, fraudulent, misleading, or otherwise harmful Content;
- publish or transmit Content that infringes intellectual property rights, privacy rights, image rights, contractual rights, or other rights of third parties;
- publish personal data of third parties without a valid legal basis or their permission where required;
- publish false or misleading information about your identity, experience, certifications, safety practices, Listings, Events, or activities;
- promote unsafe diving practices or Content that could reasonably endanger the safety of any person;
- organise, encourage, or participate in unlawful activities;
- use the Service for fraud, spam, phishing, scams, harassment, or unsolicited commercial communications;
- list, offer, request, or promote illegal goods or services;
- bypass, disable, or interfere with security measures, technical protections, moderation tools, or access controls;
- introduce malware, malicious code, or harmful files;
- scrape, crawl, harvest, copy, or access the Service by automated means except where expressly permitted by the Service Provider or by mandatory law;
- reverse engineer, decompile, disassemble, or attempt to derive the source code of the Platform, except where mandatory law allows it;
- interfere with the integrity, performance, security, or availability of the Platform;
- use the Platform in a way that could damage the Service Provider, other Users, or third parties.
The Service Provider may take proportionate action under Sections 7.4 and 16 if these rules are breached.
7. User-Generated Content
7.1 Ownership
You retain ownership of your UGC.
Nothing in these Terms transfers ownership of your copyrights or other intellectual property rights to the Service Provider.
7.2 Licence granted to the Service Provider
By submitting, uploading, publishing, or otherwise making UGC available through the Platform, you grant the Service Provider a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, make available, transmit, and technically adapt your UGC solely to the extent necessary to operate, secure, provide, and display the Service in accordance with these Terms and your available settings.
This licence includes technical operations such as formatting, resizing, compressing, caching, backing up, and displaying UGC through the Platform or through technical providers used to operate the Service.
This licence:
- is not an assignment or transfer of ownership;
- does not allow the Service Provider to sell your UGC as standalone content;
- does not allow unrelated commercial exploitation of your UGC;
- does not waive your moral rights where such rights cannot be waived under applicable law;
- ends when you delete the relevant UGC or your Account, subject to technical retention in encrypted backups and legal retention needs as described in the Privacy Policy.
Where your UGC has been shared with or accessed by other Users before deletion, the Service Provider may not be able to delete copies, screenshots, exports, emails, or other materials already held by those Users outside the Platform.
7.3 Your warranties regarding UGC
You represent and warrant that:
- you have the rights, permissions, and legal basis necessary to submit your UGC;
- your UGC does not infringe the rights of any third party;
- your UGC does not violate applicable law;
- your UGC does not contain malware or intentionally harmful material;
- your UGC complies with these Terms.
7.4 Moderation and content restrictions
The Service Provider does not generally pre-screen all UGC and does not undertake a general obligation to monitor Users.
However, the Service Provider may review, remove, disable, restrict, de-index, or limit visibility of UGC, Listings, Events, profiles, or Accounts where reasonably necessary to:
- enforce these Terms;
- protect Users or third parties;
- protect platform security;
- prevent fraud, spam, abuse, or unlawful activity;
- comply with applicable law or lawful authority requests;
- address Content that appears unlawful, unsafe, misleading, infringing, or incompatible with the nature of the Service.
Uploaded files may be automatically scanned using ClamAV for malware detection. Files identified as malicious or technically unsafe may be blocked, removed, or quarantined.
Except for technical security tools such as malware scanning and anti-abuse measures, moderation decisions are not intended to be based solely on automated decision-making. Where legally required, affected Users may receive information about significant moderation decisions and may request review by contacting [email protected].
Users may report allegedly unlawful, infringing, unsafe, or Terms-violating Content by contacting [email protected] and providing sufficient information to identify the Content and explain the issue.
8. Marketplace-Style Listings and Events
8.1 Notice-board nature
Listings and Events are created and managed by Users.
The Service Provider does not verify, endorse, certify, guarantee, or control:
- the identity, qualifications, certifications, or reliability of Users;
- the accuracy or completeness of Listings or Events;
- the lawfulness, safety, quality, availability, or suitability of any goods, services, activities, or opportunities mentioned by Users;
- the actual performance of any agreement between Users;
- the safety of any dive, meeting, trip, event, course, activity, or transaction arranged between Users.
8.2 No party to User arrangements
The Service Provider is not a party to any contract, transaction, payment, meeting, event, dive, training activity, sale, purchase, rental, exchange, or other arrangement between Users.
Users are solely responsible for:
- verifying the identity and reliability of other Users;
- verifying certifications, experience, authorisations, and insurance where relevant;
- assessing safety, legality, quality, and suitability;
- complying with applicable laws and regulations;
- resolving any dispute with other Users.
8.3 Transactions outside the Platform
Any financial transaction relating to a Listing, Event, or User arrangement occurs entirely outside the Platform.
The Service Provider does not:
- process payments;
- hold funds;
- provide escrow;
- collect commissions;
- guarantee payment;
- guarantee delivery;
- guarantee performance;
- mediate refunds or returns;
- assume liability for transactions between Users, except where liability cannot be excluded under mandatory law.
9. User-to-User Contact Function
9.1 How the Contact Function works
When you use the "Contact" function on a Listing or Event page, the Platform transmits the following information to the recipient, usually the Listing owner or Event organiser, by email:
- your display name;
- the email address associated with your Account;
- the message you submit through the contact form.
This allows the recipient to reply to you directly outside the Platform.
9.2 No message-content storage
The Service Provider does not store the content of messages submitted through the Contact Function after forwarding them.
Transactional email metadata may be retained as described in the Privacy Policy.
9.3 No responsibility for inter-User communications
The Service Provider is not responsible for the content, accuracy, legality, consequences, or outcome of communications or interactions between Users initiated through the Contact Function, except where liability cannot be excluded under mandatory law.
You are responsible for exercising caution before sharing personal information, arranging meetings, making payments, attending activities, or relying on information received from another User.
10. Medical, Safety, and Assumption of Risk
10.1 Inherent risks of freediving
Freediving, breath-hold diving, underwater training, spearfishing, open-water activities, pool training, and related activities are inherently dangerous.
They may involve serious risks, including:
- hypoxic blackout;
- loss of consciousness;
- drowning;
- barotrauma;
- decompression illness;
- injury;
- disability;
- death.
These risks cannot be eliminated, even with training, supervision, equipment, experience, or certification.
10.2 Your responsibility
Any decision to engage in freediving or any related activity is made by you independently and at your own risk.
You are solely responsible for assessing:
- your physical and psychological fitness;
- your training and experience;
- your certifications and their validity;
- your equipment;
- environmental and weather conditions;
- local laws and safety rules;
- the reliability and competence of any Buddy, organiser, instructor, or other person;
- whether an activity is safe and appropriate for you.
You should never rely solely on information available through the Platform when making safety-critical decisions.
10.3 No medical, training, safety, or emergency advice
Content available through the Platform, including Logbook data, profile information, Declared Certification Levels, Listings, Events, Buddy interactions, and User communications, is provided for community and informational purposes only.
It does not constitute:
- medical advice;
- medical diagnosis;
- fitness-to-dive assessment;
- training instruction;
- professional safety advice;
- certification;
- emergency guidance;
- supervision.
You must seek advice from qualified professionals where appropriate and must contact local emergency services directly in an emergency.
10.4 Safe practice
You are responsible for following recognised freediving safety practices, including using qualified in-person supervision, avoiding unsafe practices, complying with local laws and regulations, and ensuring that any activity is appropriate for your training, certification, health, and experience.
The Service Provider does not supervise, monitor, or control activities arranged between Users.
10.5 Dive metrics are not medical records
Depth, duration, location, notes, and other dive metrics voluntarily entered in the Logbook are activity and performance records only.
They are not medical records, medical certificates, fitness certifications, or proof of fitness-to-dive.
11. Service Availability and Continuity
The Service Provider will use reasonable care to operate the Platform securely and reliably.
However, the Service is provided without any guaranteed uptime, service-level commitment, uninterrupted availability, or error-free operation.
The Service Provider may suspend, restrict, interrupt, or modify the Service, in whole or in part, where reasonably necessary for:
- maintenance;
- updates;
- security;
- bug fixes;
- technical operations;
- legal compliance;
- anti-abuse measures;
- infrastructure failures;
- third-party service disruptions;
- force majeure or events beyond the Service Provider's reasonable control;
- changes in the pre-launch, invite-only, or public availability phase.
Where reasonably possible, the Service Provider will provide notice of significant planned interruptions or material changes. No compensation or refund is due for Service interruptions where the Service is provided free of charge, except where liability cannot be excluded under mandatory law.
12. Personal Data
The Service Provider processes personal data in accordance with the Privacy Policy, available at freedivinghome.com.
The Privacy Policy explains, among other things:
- what personal data is processed;
- why it is processed;
- legal bases for processing;
- retention periods;
- data recipients and transfers;
- your data protection rights;
- how to contact the Service Provider for privacy requests.
These Terms do not limit any rights you may have under the GDPR, Italian privacy law, or other applicable data protection law.
13. Intellectual Property
13.1 Platform intellectual property
All rights in the Platform, including software, source code, databases, interfaces, design, layout, logos, graphics, trademarks, trade names, documentation, and non-User Content, belong to the Service Provider or its licensors.
13.2 Limited licence to use the Platform
Subject to your compliance with these Terms, the Service Provider grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for lawful personal purposes and in accordance with these Terms.
13.3 Restrictions
You must not:
- copy, reproduce, distribute, sell, lease, sublicense, or commercially exploit the Platform;
- modify, adapt, translate, or create derivative works of the Platform;
- reverse engineer, decompile, disassemble, or attempt to derive source code, except where mandatory law permits it;
- remove ownership, copyright, trademark, or proprietary notices;
- use the Platform in a way that infringes the Service Provider's or third parties' rights.
These restrictions do not limit rights that cannot be excluded under mandatory law.
14. Limitation of Liability
14.1 Service provided as available
The Service is provided on an "as available" basis.
To the maximum extent permitted by applicable law, the Service Provider does not guarantee that:
- the Service will always be available;
- the Service will be uninterrupted, error-free, or free from vulnerabilities;
- all User Content will be accurate, complete, lawful, safe, or up to date;
- the Service will meet your specific expectations or be suitable for a specific diving, training, medical, commercial, or safety purpose;
- other Users will act lawfully, safely, honestly, or reliably.
Nothing in these Terms excludes any mandatory legal guarantee or consumer protection that cannot be excluded under Italian or EU law.
14.2 Exclusion of indirect damages
To the maximum extent permitted by applicable law, the Service Provider is not liable for indirect, consequential, special, incidental, punitive, or non-pecuniary damages, including loss of profits, data, reputation, goodwill, business opportunities, or other intangible losses arising out of or in connection with the use of, or inability to use, the Service.
14.3 User conduct, User Content, Events, Listings, and external transactions
To the maximum extent permitted by applicable law, the Service Provider is not liable for:
- acts, omissions, negligence, misrepresentations, or misconduct of Users or third parties;
- inaccurate, incomplete, misleading, unsafe, or unlawful UGC;
- Listings, Events, Buddy interactions, or User communications;
- the organisation, management, conduct, safety, cancellation, or outcome of activities arranged between Users;
- injury, damage, loss, or death arising from freediving or related activities arranged outside the Platform;
- financial transactions, payments, refunds, deliveries, returns, or disputes between Users;
- reliance on Declared Certification Levels or other unverified User statements.
14.4 Mandatory exceptions
Nothing in these Terms limits or excludes liability for:
- death or personal injury caused by the Service Provider's negligence;
- wilful misconduct or gross negligence of the Service Provider;
- fraud;
- breach of mandatory consumer rights;
- breach of mandatory data protection rights;
- any liability that cannot lawfully be limited or excluded under applicable Italian or EU law.
15. Indemnification
To the maximum extent permitted by mandatory consumer law, you are responsible for losses, claims, damages, liabilities, costs, and expenses reasonably incurred by the Service Provider, his authorised representatives, collaborators, or service providers as a direct result of:
- your intentional or negligent breach of these Terms;
- your unlawful use of the Service;
- your UGC infringing third-party rights or applicable law;
- your fraud, misrepresentation, or impersonation;
- your unlawful or negligent conduct in relation to another User;
- any contract, transaction, meeting, event, or activity you arrange with another User outside the Platform.
This Section does not require you to indemnify the Service Provider for losses caused by the Service Provider's own wilful misconduct, gross negligence, breach of mandatory law, or liability that cannot be excluded under Italian or EU law.
16. Suspension and Termination
16.1 Suspension or termination by the Service Provider
The Service Provider may suspend, restrict, or terminate your Account or access to the Service where reasonably necessary due to:
- breach of these Terms;
- unlawful conduct;
- infringement of third-party rights;
- fraud, spam, abuse, harassment, or unsafe conduct;
- security risks;
- suspected unauthorised access;
- malicious files or technical threats;
- legal or regulatory requirements;
- requests from competent authorities;
- extended inactivity, after reasonable notice where practical;
- discontinuation or material modification of the Service.
Where reasonably possible and legally appropriate, the Service Provider will provide notice of the reason for suspension or termination. Immediate action may be taken without prior notice where necessary to protect Users, third parties, the Platform, or the Service Provider, or to comply with law.
16.2 Termination by the User
You may terminate your Account at any time by using the available account-deletion function, where available, or by contacting [email protected].
Account deletion and related data handling are described in the Privacy Policy.
16.3 Effects of termination
Termination does not affect rights or obligations that accrued before termination.
Sections that by their nature should survive termination will continue to apply, including provisions on intellectual property, UGC licences already necessary for technical backup retention, liability, indemnification, governing law, jurisdiction, and dispute handling.
17. Modifications to These Terms
The Service Provider may modify these Terms from time to time for justified reasons, including:
- legal or regulatory changes;
- security needs;
- technical changes;
- operational changes;
- changes to the Service's features;
- prevention of abuse or fraud;
- changes in the pre-launch, invite-only, or public availability phase;
- clarification of existing wording;
- changes required by providers or infrastructure.
Material changes that significantly affect your rights or obligations will not apply retroactively unless required by law.
Where reasonably possible, the Service Provider will notify Users in advance of material changes, for example by email to the address associated with the Account or by a prominent in-platform notice.
If a change requires your express consent under applicable law, the Service Provider will request that consent separately.
If you do not accept material changes, you may terminate your Account and stop using the Service. Continued use of the Service after the effective date of notified changes may be treated as acceptance of the revised Terms to the extent permitted by applicable law.
18. Consumer Right of Withdrawal
If you qualify as a Consumer and these Terms constitute a distance contract for a digital service or digital content under applicable consumer law, you may have the right to withdraw from the contract within 14 days from acceptance of these Terms, without giving any reason.
You may exercise withdrawal by:
- deleting your Account, where the account-deletion function is available; or
- sending a clear withdrawal request to [email protected].
FreedivingHome is currently provided free of monetary charge. Therefore, if you withdraw, no refund is due because no payment has been made to the Service Provider.
Because access to the Service normally begins immediately after registration, withdrawing from the contract means that your Account will be closed and access to account-based features will end. Personal data will be handled as described in the Privacy Policy.
The Service Provider does not currently rely on an automatic exclusion of the withdrawal right. If future features or paid services require immediate supply of digital content or immediate full performance of a digital service in a way that affects withdrawal rights, the Service Provider will request any express consent and acknowledgement required by applicable law before relying on a statutory exception.
19. Governing Law
These Terms are governed by Italian law.
If you qualify as a Consumer, this choice of law does not deprive you of any mandatory consumer protections provided by the law of the country in which you habitually reside, where such protections apply and cannot be waived by contract.
20. Jurisdiction
If you qualify as a Consumer, any dispute between you and the Service Provider will be subject to the mandatory jurisdiction rules applicable to consumers, including the court of your place of residence or domicile where required by applicable law.
Where you do not qualify as a Consumer, or where mandatory consumer-forum rules do not apply, any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the Court of Milan, Italy.
Nothing in this Section limits any mandatory right you may have to bring a claim before another competent court or authority under applicable consumer law.
21. Notices
Notices from the Service Provider to you may be provided:
- by email to the address associated with your Account;
- through in-platform notices;
- through notices published on the Platform, where appropriate.
Notices from you to the Service Provider must be sent to:
You are responsible for keeping your Account email address up to date.
22. Severability and Entire Agreement
If any provision of these Terms is held invalid, void, or unenforceable, the remaining provisions remain valid and enforceable to the maximum extent permitted by applicable law.
Any invalid, void, or unenforceable provision will be disregarded or interpreted, where legally possible, in a manner consistent with applicable law and closest to the original lawful purpose of the provision.
These Terms constitute the entire agreement between you and the Service Provider regarding use of the Service.
The Privacy Policy is provided alongside these Terms for transparency regarding personal data processing and does not reduce or waive any rights granted by data protection law.
ANNEX A — Specific Approval of Potentially Burdensome Clauses
Pursuant to Articles 1341, paragraph 2, and 1342 of the Italian Civil Code
Pursuant to and for the purposes of Articles 1341, paragraph 2, and 1342 of the Italian Civil Code, the User specifically and separately approves the following clauses of these Terms of Service.
This specific approval is requested through a separate checkbox or equivalent distinct action during registration or acceptance of the Terms.
Specific approval of the clauses listed below does not exclude, limit, or waive any mandatory consumer protection, privacy right, liability rule, or other right that cannot be waived under applicable Italian or EU law. Any clause that is void or unenforceable under mandatory consumer law remains void or unenforceable despite specific approval.
The clauses specifically approved are:
- Section 7.2 — Licence granted by the User to the Service Provider for User-Generated Content;
- Section 7.4 — Moderation, removal, restriction, disabling, or limitation of Content, Listings, Events, profiles, or Accounts;
- Section 8.1 — Notice-board nature of Listings and Events and absence of verification, endorsement, certification, or guarantee by the Service Provider;
- Section 8.2 — Service Provider not being a party to User arrangements and Users' sole responsibility for arrangements between them;
- Section 8.3 — Exclusion of Service Provider responsibility for transactions occurring outside the Platform;
- Section 9.3 — Exclusion of responsibility for inter-User communications and interactions initiated through the Contact Function;
- Section 10 — Medical, safety, and assumption-of-risk provisions, including the absence of medical, training, safety, certification, or emergency advice;
- Section 11 — Service availability limitations and the Service Provider's right to suspend, restrict, interrupt, or modify the Service;
- Section 13.3 — Restrictions on use of the Platform and intellectual property limitations;
- Section 14 — Limitation and exclusion of liability, including the "as available" provision, exclusion of indirect damages, exclusion for User conduct, User Content, Events, Listings, external transactions, and mandatory liability carve-outs;
- Section 15 — User responsibility and indemnification obligations;
- Section 16.1 — Service Provider's right to suspend, restrict, or terminate the User's Account or access to the Service;
- Section 17 — Service Provider's right to modify these Terms for justified reasons;
- Section 20 — Jurisdiction clause, including exclusive jurisdiction of the Court of Milan where consumer-forum rules do not apply.
The Service Provider records the User's general acceptance of the Terms and the User's specific approval of this Annex A separately, including timestamp, IP address, and document version reference or hash.
